Bakes & Brews
Terms of use
The ground rules for our websites, our cafés’ websites and the Bakes & Brews Community Shelf, in plain words.
Effective date: October 6, 2026
In short
- These terms cover bakesandbrews.shop, the Community Shelf app at shelf.bakesandbrews.shop, and each of our café websites that links here, such as bbantioch.com.
- You don’t need an account to browse the shelf, hold a packet or buy one. Signing in is only for a profile or to sell.
- Produce on the shelf is grown by neighbours, not by us. We check every post, but please look at it and wash it before you eat it.
- A hold keeps one packet for you until closing on the day you choose. You pay at our counter.
- Sellers share only what they grew themselves. We collect the money and pay sellers ourselves.
- Our privacy policy explains how we handle your information.
Who we are and what these terms cover
Bakes & Brews is an Indian-American café and bakery business based at 5019 Lone Tree Way, Ste B, Antioch, CA 94531. In these terms, “we”, “us” and “our” mean Bakes & Brews, and “you” means anyone who visits our websites or uses the Community Shelf.
These terms cover:
- this website, bakesandbrews.shop, the front door to all our cafés,
- each Bakes & Brews café website that links to these terms, such as bbantioch.com for our Antioch café, and
- the Bakes & Brews Community Shelf app at shelf.bakesandbrews.shop.
By using any of them, you agree to these terms. If you don’t agree, please don’t use them. Our privacy policy explains what information we collect and how we use it.
Using our websites
Please use our websites and the shelf the way they’re meant to be used. Don’t:
- break the law, or help anyone else break it,
- try to get into accounts, information or parts of our systems that aren’t yours,
- disrupt how the sites work, for example by overloading them, spreading harmful code or getting around our limits, such as the limit on holds,
- copy large parts of the sites with automated tools, or
- pretend to be someone else, or post anything false, hurtful or misleading.
Our cafés, menus and prices
Each café’s website shows its own menu, hours and prices. They can change, and dishes can sell out. The price the café shows when you order is the one that applies.
If a café’s website takes orders, the order page shows the price, the pickup time and anything else you need to know before you pay.
Food allergies
Our kitchens handle common allergens, and we can’t promise that any dish is free of them. If you have a food allergy, please talk to our staff before you order.
The Community Shelf
The Community Shelf is our give-back project: self-service racks inside our cafés where neighbours share what they grow at home, such as vegetables, herbs, greens and fruit. Anyone can browse the shelf without an account.
- Grown by neighbours, not by us. Each item is grown, picked and packed by the seller named on it. We review every post before it goes on the shelf, but we don’t grow, test or certify the produce.
- Check it yourself. Look at what you take, wash it before you eat it, and leave it if anything seems wrong. Tell us at the counter and we’ll take it off the shelf.
- Homegrown produce only, for now. Home-made food isn’t on the shelf yet.
- First come, first served. Packets on the rack can go before the app catches up, so what you see in the app may be a little behind.
Holds, free items and paying
- One packet at a time. Each hold is for one packet.
- Holding a packet. You give us your name, mobile number and email address, and choose the day you’ll pick it up. We show your pickup code on screen and email it to you.
- How long a hold lasts. Until the café closes on the day you chose. After that, the hold ends and the packet goes back on the shelf for someone else.
- Paying. You pay at our counter when you pick up a held packet. We don’t take payments online at the moment.
- Free items. When a grower prices an item as Free, you can just take one or hold one. Please take only what you’ll use, so there’s some for everyone.
- Fair use. We may limit how many holds one person can have at a time, and cancel holds that look like misuse.
- Something wrong? If there’s a problem with a packet you paid for, tell us at the counter or contact us and we’ll work it out with you.
Selling on the shelf
- Apply once. To sell, sign in, make a profile and apply. Our staff review each request, and we may say no.
- Only what you grew. Sell only produce you grew yourself and have the right to sell. Describe it honestly: what it is, how much is in a packet, when it was picked and when it’s best before.
- Fresh, clean and safe. Don’t bring anything spoiled or unsafe to eat, or anything treated with something that isn’t meant for food crops.
- No home-made food yet. If we open the shelf to home-made food later, sellers will need the California cottage food registration it requires.
- We check every post. We can send a post back, take an item off the shelf, or stop someone from selling, for example if a post breaks these terms or something on the rack doesn’t look right.
- Getting paid. Buyers pay us at the counter. We collect the money and pay sellers ourselves, by Zelle or cash, for packets that were paid for. We’ll tell you about any fee before it applies to your sales.
- Old stock. If an item is past its best-before date or no longer looks fresh, we may take it off the rack, and we’ll let you know how to collect it.
- Your responsibility. You’re responsible for what you sell, including any taxes or permits that apply to you.
Accounts and sign-in
- You only need an account to have a profile or to sell. You sign in with Google or Facebook, so keep that account secure.
- Give us true details, and keep your phone number and payout details up to date if you sell.
- You must be at least 13 to use the Community Shelf app.
- You can delete your account at any time from your profile, or ask us to. See Delete your data.
What you post
Your photos and words stay yours. When you post them on the shelf, you give us permission to store, show and resize them to run the shelf, for example on your seller page, on item pages and in emails about your items.
Only post photos and words you have the right to share, and keep other people’s personal details out of them. We can remove anything that breaks these terms.
Our name, logo and content
The Bakes & Brews name, logo and wordmark, our photos, and the words and design of our websites belong to us. Please don’t use them in a way that suggests you are us or that we endorse you, unless we’ve said yes first. You’re always welcome to share links to our pages.
Links to other sites
We link to sites we don’t run, like Instagram, WhatsApp and Google Maps. Their own terms and privacy policies apply there, and we aren’t responsible for them.
What we can’t promise
We work hard to keep our websites and the shelf accurate and running, but we can’t promise they’ll always be available, free of mistakes or up to date. Hours, menus, prices and what’s on the shelf can change.
As far as the law allows, our websites and the Community Shelf app are provided “as is”, and produce on the shelf is provided by its sellers “as is”, without warranties of any kind.
Limits on our responsibility
As far as the law allows, Bakes & Brews isn’t responsible for indirect or unexpected losses that come from using our websites or the Community Shelf. Our total responsibility to you for any claim about them is limited to the greater of what you paid us for the item or order the claim is about, or $100.
If you sell on the shelf and someone makes a claim against us because of something you sold or posted that breaks these terms, you agree to help us deal with it and to cover our reasonable costs.
Nothing in these terms limits anything the law doesn’t let us limit, or takes away your rights as a consumer under California law.
Pausing or closing accounts
You can stop using our websites or delete your account at any time. We can pause or close an account, remove posts or cancel holds if someone breaks these terms, puts other people at risk or misuses the shelf. If we close a seller’s account, we still pay what they’re owed for packets that were paid for.
Disputes and the law that applies
If something goes wrong, please talk to us first. Most things can be sorted out at the counter.
These terms are governed by the laws of the State of California. If we can’t settle a disagreement together, it will be handled by the courts in Contra Costa County, California, unless the law gives you the right to go elsewhere. You can always use small claims court if your claim qualifies.
Changes to these terms
We may update these terms as our cafés and the shelf change. We’ll post the new version here with a new effective date. If a change matters for sellers or account holders, we’ll tell them in the app or by email before it takes effect. If you keep using our websites after a change, the new terms apply.
